1Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and the operator of Snakein described in Section 2 ("Snakein," "we," "us," or "our") governing your access to and use of the Snakein desktop application, web dashboard, and related backend services (together, the "Service").
By creating an account, pairing a device, installing the desktop application, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, Acceptable Use Policy, and Refund Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
2Who We Are
Snakein is currently developed and operated by an individual acting in a personal capacity (the "Operator"), pending the formation of a dedicated legal entity for the business. The Operator is the counterparty to these Terms and can be reached through our contact page for all legal, privacy, billing, and support matters.
3Definitions
- "Session" means a single use of the Service to capture, transcribe, and/or record a call or meeting, together with any transcript, audio recording, screenshots, notes, and AI-generated summary associated with it.
- "User Content" means any material you submit to or generate through the Service, including audio captured through your microphone or system audio, screenshots, transcripts, profile information (such as résumés or biographical material), and notes.
- "AI Output" means any answer, explanation, suggestion, code sample, or summary generated by the Service using third-party AI models.
- "Credits" means the prepaid usage credits used to meter and pay for AI- and transcription-related features of the Service, as described in Section 11.
- "Credit Code" means a single-use code that credits a fixed number of Credits to the account that redeems it, as described in Section 12.
- "Share Link" means a publicly accessible web address that displays some or all of a Session, created using the Service's sharing feature described in Section 14.
- "Overlay Feature" means the functionality described in Section 7 that attempts to keep the Snakein desktop window out of the video captured by certain screen-sharing software.
4Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and of the device-pairing token used by the desktop application, and for all activity that occurs under your account. Notify us immediately through our contact page if you suspect unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.
5Description of the Service
Snakein is a personal, single-user tool designed to give you private, on-screen notes and AI-assisted talking points during a call or meeting, visible only to you. Depending on the features you use, the Service may:
- capture system audio and/or microphone audio during a call and transcribe it in real time;
- generate suggested answers or talking points in response to questions detected in the transcript or in a screenshot you capture, using third-party AI models;
- record and mix call audio, store screenshots, and generate a written summary of a completed Session;
- keep the desktop application window out of the video stream captured by certain third-party screen-sharing software when you share your screen, as described in Section 7;
- let you generate a Share Link to make a Session, or part of it, viewable by anyone who has the link, as described in Section 14;
- meter usage of AI and transcription features in Credits purchased and consumed as described in Section 11.
The Service, and the specific platforms and AI providers it integrates with, may change over time, including through the addition, modification, or removal of features, without prior notice, as described in Section 23.
6Recording Calls and Other People
Using the Service to capture system audio or microphone audio during a call is very likely to capture the voice, and potentially other personal data, of other participants in that call who have not agreed to these Terms and may not know a recording, transcription, or AI-assistance tool is in use ("Other Participants").
Laws on recording conversations vary significantly by country and, within some countries, by state or region. In many jurisdictions - including a number of U.S. states, EU member states, and others - recording a private conversation without the knowledge or consent of some or all participants is unlawful and can expose the person recording to civil liability and, in some cases, criminal penalties.
You are solely responsible for determining what consent or notice, if any, is legally required in your situation, and for obtaining it before using any recording, transcription, or AI-assistance feature of the Service. You are also solely responsible for complying with any employment agreement, workplace policy, non-disclosure agreement, code of conduct, or platform terms that may prohibit recording a call, taking AI-assisted notes, or using a similar tool during it.
We do not monitor your Sessions, do not verify that you have obtained any required consent, and have no way of knowing whether your use of the Service in a given call is lawful or authorized. We expressly disclaim all liability arising from your recording of, or use of the Service in connection with, calls involving Other Participants, and you agree to indemnify us as set out in Section 21 for any claim brought by an Other Participant or any third party in connection with your use of the Service.
7The Overlay Feature Has No Guarantee of Effectiveness
The Overlay Feature is intended to prevent the Snakein application window from appearing in the video output of certain third-party screen-sharing and video-conferencing applications (currently including Zoom, Google Meet, and Microsoft Teams) when you share your screen.
The Overlay Feature relies on operating-system window-capture behavior that is not officially documented, supported, or contractually guaranteed for this purpose by Apple, Microsoft, or any video-conferencing provider, uses at least one system flag that has been deprecated by its platform vendor, and may stop working, partially or entirely, at any time as a result of an operating-system update, an update to a video-conferencing application, a change in how you share your screen (for example, sharing a single window instead of the full screen, or using a virtual camera or third-party recording software), or for any other reason outside our control.
WE DO NOT WARRANT, AND EXPRESSLY DISCLAIM, THAT THE OVERLAY FEATURE IS OR WILL REMAIN EFFECTIVE, UNDETECTABLE, OR COMPATIBLE WITH ANY PARTICULAR OPERATING SYSTEM VERSION, APPLICATION VERSION, OR SCREEN-SHARING CONFIGURATION AT ANY GIVEN TIME. You use the Overlay Feature entirely at your own risk. You are solely responsible for any consequence - including embarrassment, loss of opportunity, disciplinary action, or legal claims by a third party - if the Snakein window or its contents become visible to another call participant, and we bear no responsibility for such consequences.
8AI-Generated Content: No Warranty; No Outcome Guarantee
The Service uses third-party AI models, which we may add, replace, or discontinue at any time, to generate AI Output, including suggested answers, code explanations, and Session summaries. AI Output is generated automatically and may be incomplete, generic, outdated, factually incorrect, or invented outright - including biographical, professional, or technical details that go beyond, or are not derived from, any résumé, profile, or material you provided.
AI Output is provided solely for your convenience and does not constitute professional, legal, career, financial, medical, or technical advice. You are solely responsible for reviewing AI Output and deciding whether, and how, to rely on it or to repeat any part of it to another person, including in a job interview, meeting, or examination.
We do not guarantee that using the Service will help you pass an interview or assessment, obtain a job offer, retain a position, or achieve any other particular outcome. We are not responsible for any consequence of an interviewer, employer, colleague, examining body, or platform discovering that you used the Service or relied on AI Output, including without limitation rejection of an application, rescission of an offer, termination of employment, disciplinary action, or legal claims against you.
9Acceptable Use
Our Acceptable Use Policy sets out in detail what the Service is for and where it must not be used, and forms part of these Terms. In addition to that Policy, you agree not to use the Service to:
- record, transcribe, or otherwise process a call without the consent or notice required by applicable law or by an agreement binding on you;
- complete or assist in completing a professionally licensed, accredited, proctored, or otherwise legally binding examination or certification assessment (for example, a bar exam, a medical or engineering licensing exam, or a government certification test), where the examining body's rules prohibit such assistance;
- impersonate any person, misrepresent your affiliation with any person or organization, or otherwise commit fraud against a third party;
- violate the intellectual property, privacy, or other rights of any person, including an Other Participant in a call;
- reverse-engineer, decompile, circumvent, or attempt to defeat the security, billing, or detection-avoidance mechanisms of the Service, or resell, sublicense, or provide access to the Service to a third party without our written consent;
- abuse the Credit or Credit Code system, including by generating, guessing, or redeeming Credit Codes you were not authorized to receive, or by submitting false or unverifiable proof of a cryptocurrency payment;
- use automated means (bots, scrapers) to access the Service outside of the desktop application and web dashboard we provide;
- upload or generate content that is unlawful, defamatory, harassing, or that infringes a third party's rights; or
- use the Service in any way that violates the acceptable-use policies of the underlying AI, transcription, or storage providers referenced in Section 17, as those policies may be updated from time to time.
We may investigate suspected violations and take action as described in Section 22.
10Compliance with Third-Party Platforms and Policies
Video-conferencing platforms (such as Zoom, Google Meet, and Microsoft Teams), employers, examining bodies, and other services you use alongside Snakein have their own terms of service, codes of conduct, and policies, which may restrict or prohibit recording, screen-share overlays, transcription, or AI-assistance tools such as Snakein. It is your sole responsibility to review and comply with those terms. Using the Service in a way that violates a third party's terms may have consequences for your account with that third party (including suspension) for which we bear no responsibility.
11Fees, Credits, and Billing
Certain features of the Service (including AI-generated answers, screenshot analysis, live transcription, and Session summaries) consume Credits, which you purchase in advance in fixed packs at the prices displayed in the Service at the time of purchase. Credits meter actual usage of third-party AI and transcription providers at rates we set based on our underlying costs. Optional modes that you enable yourself - such as "Power Mode", which you switch on for a single Session before a call - send your request to a more expensive AI model, which may belong to a different provider, and therefore consume Credits at a significantly higher rate; the Service tells you this before you enable them, and our Privacy Policy describes how your content is processed in each mode.
- We do not accept card payments and do not collect or store card numbers, bank details, or similar payment instrument data. There are only two ways to obtain Credits: a cryptocurrency (USDT) transfer that you send to the deposit address shown in the Service and that we verify manually, or a Credit Code redeemed in your account (Section 12).
- Cryptocurrency top-ups are reviewed by hand. A top-up request stays pending until we verify the transaction you submitted; Credits are credited only once we do. We may reject a request we cannot verify, in which case no Credits are credited. Our Refund Policy describes this process, and the limited circumstances in which we make things right, in full.
- Credits are non-refundable once purchased, except where required by applicable law or where our Refund Policy provides otherwise, and have no cash value. Unused Credits do not expire unless we state an expiration at the time of purchase or in the Service.
- Features that consume Credits will not function once your balance reaches zero, and an in-progress Session may be paused or ended if your balance is exhausted mid-call, as indicated in the Service.
- We may change Credit prices or the Credit cost of a feature at any time, effective for purchases and usage made after the change is published in the Service.
- We may suspend your account and, to the extent permitted by law, forfeit a Credit balance obtained through a fraudulent or unverifiable payment, or through abuse of the top-up review process, without affecting our right to recover any resulting loss from you.
- All fees are exclusive of any applicable taxes, which are your responsibility unless we are legally required to collect them.
12Credit Codes and Promotions
We may issue single-use Credit Codes redeemable for a fixed Credit amount. Credit Codes have no cash value, cannot be resold or exchanged for cash, may be restricted to specific users or campaigns, and may be limited, modified, or revoked by us at any time, including where we reasonably suspect fraud or abuse of the Credit Code system.
A Credit Code may also reach you through a third party - a reseller, a promotion, or a gift. We do not process, see, or hold any payment you may have made to that third party for a code, and any dispute about what you paid for it is between you and them, as our Refund Policy explains.
13Session Storage, Data Handling, and Security
When you complete a Session, its audio recording, screenshots, transcript, and summary are stored using third-party cloud storage infrastructure, as described in our Privacy Policy. Stored files are addressed using long, randomly generated identifiers rather than being indexed or made discoverable, but a stored file is accessible to anyone who obtains its exact web address, without requiring them to sign in. We do not guarantee that a link to your Content, once it exists, cannot be accessed by someone you did not intend to give access to if that link is disclosed, whether by you or otherwise. Treat any link to your Content as sensitive, and do not use the Service to store Content you would not accept becoming accessible to a third party who obtains the link.
You may request deletion of your account and associated Content through our contact page, subject to any retention we are required to apply by law or need to apply to resolve disputes, enforce these Terms, or prevent fraud, as further described in our Privacy Policy.
14Public Sharing of Sessions
The Service lets you generate a Share Link that makes a Session, or a summary of it, viewable by anyone who has the link, without requiring them to have an account. A Share Link is not password-protected or otherwise access-restricted unless the Service states otherwise, and remains accessible until you revoke it or we remove it.
Before creating a Share Link, you are solely responsible for ensuring that sharing the associated Content does not violate the privacy, confidentiality, or other rights of any Other Participant captured in it, or any confidentiality obligation binding on you (for example, an employer's non-disclosure agreement or a policy against sharing interview questions). We may disable or remove a Share Link at any time, with or without notice, including in response to a complaint described in Section 15.
15Reporting Abuse or Requesting Removal of Shared Content
If you believe that content made available through a Share Link violates your rights - for example, because it contains a recording of you without your consent - contact us through our contact page with the Share Link and a description of the issue. We will review the report in good faith and may disable the Share Link pending or following that review, at our discretion.
16Intellectual Property
The Service, including its software, design, trademarks, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal use.
As between you and us, you retain ownership of User Content you submit. By using the Service, you grant us a worldwide, non-exclusive license to host, process, transmit, and display your User Content solely as needed to provide the Service to you (including sending it to the third-party AI and storage providers described in Section 17) and, where you create a Share Link, to make the shared Content available as you have directed.
As between you and us, you may use AI Output generated for you, subject to these Terms and to any restrictions imposed by the underlying AI provider. Because AI Output is generated automatically and similar prompts can produce similar results for different users, we do not warrant that any AI Output is unique to you or free of third-party rights, and we disclaim any liability arising from your use of AI Output in a context requiring originality (for example, a work-product submission you represent as your own).
If you send us feedback or suggestions about the Service, you grant us the right to use them without restriction or compensation to you.
17Third-Party Services
The Service relies on third-party providers to function, including AI model providers, a transcription provider, cloud storage and hosting infrastructure, and a transactional email provider. We select, add, replace, and discontinue these providers at our discretion, without notice to you, and neither this Agreement nor any other statement by us commits the Service to any particular provider, model, or processing location. Your use of the Service is also subject to the applicable terms and acceptable-use policies of these providers. We do not control these providers, do not warrant their availability, accuracy, or continued participation, and are not liable for their acts, omissions, outages, or policy changes, including any resulting interruption or change to the Service.
18Privacy and Data Protection
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. In summary:
- General. We process personal data (including account details, Session Content, and payment metadata) to provide, secure, and bill for the Service, based on the performance of our contract with you, our legitimate interest in operating and improving the Service, and, where applicable, your consent.
- EEA / UK users (GDPR). You have rights to access, correct, delete, restrict, or port your personal data, and to object to certain processing. Where we transfer personal data outside the European Economic Area or the United Kingdom, we do so using appropriate safeguards as required by applicable data protection law. You may contact us through our contact page to exercise these rights or to lodge a complaint with your local data protection authority.
- California users (CCPA/CPRA). We do not sell or share your personal information for cross-context behavioral advertising. You have the right to know what personal information we hold about you, to request its deletion or correction, and to be free from discrimination for exercising these rights. You may exercise these rights through our contact page.
- Other jurisdictions. If your local law grants you additional data-protection rights, we will honor them to the extent required, on request through our contact page.
19Disclaimer of Warranties
THE SERVICE, INCLUDING THE OVERLAY FEATURE AND ALL AI OUTPUT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON- INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that the Service will be available at all times, that data loss will never occur, or that any given feature, including features in active development, will remain available or behave identically over time. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you to the extent prohibited by law.
20Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR OPPORTUNITY (INCLUDING A LOST JOB OFFER OR EMPLOYMENT), ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) FIFTY U.S. DOLLARS (US$50) OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for our fraud or, where applicable, gross negligence.
21Indemnification by You
You agree to defend, indemnify, and hold harmless the Operator and any future legal entity operating Snakein, and its officers, employees, and contractors, from and against any claim, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service, including your use of recording, transcription, Overlay, or Share Link features; (b) your violation of these Terms, including Sections 6, 9, or 10; (c) your violation of any law or of a third party's rights, including an Other Participant's rights; or (d) User Content you submit or share, including through a Share Link.
22Suspension and Termination
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms or our Acceptable Use Policy, created risk or possible legal exposure for us or another person, or engaged in fraud or abuse of the Credit or Credit Code system. You may stop using the Service and request deletion of your account at any time as described in Section 13.
Upon termination, your right to use the Service ends immediately. Sections 6-9 and 13-21 survive termination. We are not obligated to refund unused Credits upon termination for a violation of these Terms, except where required by applicable law.
23Changes to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service at any time, including features still under active development, and we may add, remove, or change the third-party AI, transcription, or storage providers referenced in Section 17.
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms in the Service or by other reasonable means, and will update the "Last updated" date above. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of them.
24Governing Law and Dispute Resolution
These Terms, and any dispute arising out of or relating to them or the Service (including non-contractual disputes), are governed by the laws of the Republic of Costa Rica, without regard to its conflict-of-laws principles. Subject to the paragraph below, you and we submit to the exclusive jurisdiction of the competent courts sitting in San José, Costa Rica.
If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction that grants you mandatory consumer-protection rights that cannot be limited by contract, nothing in this Section limits those rights, and you may bring proceedings before the competent court of your own country of residence in addition to the courts identified above.
25Export Control and Sanctions
You represent that you are not located in, and are not a national or resident of, any country or region subject to comprehensive trade sanctions, and are not on any government list of prohibited or restricted parties. You agree not to use the Service in violation of any applicable export control or sanctions law.
26General Provisions
- Force majeure. We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including outages of a third-party provider referenced in Section 17.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all our assets.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be replaced by an enforceable provision that most closely reflects its intent.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
- Entire agreement. These Terms, together with the Privacy Policy, the Acceptable Use Policy, and the Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on the subject.
- Language. These Terms are drafted in English. Any translation is provided for convenience only, and the English version controls in case of conflict.
